Benefits of a professional contract review

Case study

Dr C was a part time salaried GP that had been with their employer since 2022. Their employing practice recently updated their contract to bring it in line with the latest GMC regulations. To be sure all was in order, Dr C contacted MDS for a professional contract review before they signed it.

MDS Advice & Outcome

MDS examined Dr C’s both current and new employment contracts, studied in depth the supporting documents provided, such as the Employee Handbook, considered any statutory rights regarding Dr C’s leave entitlements, and looked at their current payslip.

Overall, the new contract complied with GMC regulations and employment requirements. However MDS advised Dr C to seek further clarifications from their employer regarding their expenses policy, as the contractual term regarding home visits expenses appeared to contradict that of the Employee Handbook.

MDS also advised Dr C to seek clarity on the arrangements around lunch breaks, time for continuous professional development, and their salary scale, as the contract terms regarding those points were vague.

Learning points

  • Always check a new employment contract carefully even if you think there are no major changes
  • Before signing your new contract, take the opportunity to discuss with your employer areas of ambiguity so you can both come to an agreement on redrafting certain contract clauses to provide clarity
  • If you prefer a professional contract review, check if your Medical Defence Organisation or other organisation you are a member of, offers such a service.
