Case study

Dr A, a trainee at ST6 level, received an ARCP (Annual Review of Competence Progression) outcome 3. Their Host NHS Trust determined that their ST5 training would be extended for six months, with another review scheduled at the end of that period.   

In anticipation of this extension and assuming Dr A would remain at ST5 level, the Trust issued a new ST5 contract with a lower salary than their current ST6 pay. Dr A questioned whether they were obligated to accept this new contract.

MDS Advice & Outcome

MDS advised Dr A that they were under no obligation to accept the ST5 contract. The Trust’s pre-determination of Dr A’s ST5 status before the next ARCP review was inappropriate. The advice highlighted that a new contract should only be issued after an ARCP review has concluded and the outcome is known. 

Dr A’s case was successfully resolved by raising the issue with the Trust. This resulted in the correct contract being issued following the subsequent ARCP meeting, emphasising the importance of challenging incorrect procedures.

  • Trainee doctors may have their training extended to meet specific requirements before progressing.
  • Host NHS Trusts should not issue new training contracts before the ARCP review meeting, as the outcome of that meeting determines the appropriate training level and associated contract.
  • Contracts should reflect the outcome of the ARCP review.
